These Terms of Service ("Terms") govern your use of https://thegoodseason.co.uk (the "Site") and your purchase of goods from The Good Season ("we", "us", "our"). By accessing the Site or placing an order you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About us
The Good Season is the trading name of The Good Season Co. Ltd, a company registered in England & Wales under company number 14988350, with its registered office at 15 Surrey Close, Corby, England, NN17 2TG. We are a UK-based luxury photography house. 2. Eligibility and accounts
You must be at least 18 years old and able to form a legally binding contract to place an order. If you create an account you are responsible for keeping your login credentials confidential and for all activity on your account. Please notify us immediately if you suspect unauthorised use.
3. Products, pricing, and availability
We take care to describe our products accurately, but subtle variations in tone, grain, frame, and finish are inherent to handmade and print-based work and are not defects. All prices are shown in pounds sterling (GBP) and are inclusive of UK VAT where applicable. Shipping and any applicable duties or import charges are shown at checkout.
We reserve the right to correct pricing errors and to limit quantities. If we find a significant pricing error after you order, we will contact you to confirm the correct price or refund you in full.
4. Orders and contract formation
Your order is an offer to buy. A binding contract is formed only when we send you an order-confirmation email. We may decline orders for any lawful reason, including suspected fraud, stock issues, delivery restrictions, or pricing errors.
5. Payment
Payment is taken in full at the time of order via our approved providers (Shopify Payments, PayPal, Apple Pay, Google Pay, Klarna). You warrant that the payment method used is yours or that you have the cardholder's authorisation to use it.
6. Shipping and delivery
Every piece sold by The Good Season is printed, hand-framed and assembled to order. You should allow up to 14 working days from order to doorstep. Delivery is free on every order and every size, to every destination we ship to. UK orders travel by a tracked, next-working-day insured courier with an hour delivery window by SMS or email; international orders travel by tracked, insured air-mail. Full details are set out in our Shipping Policy. Risk of loss passes to you on delivery. International orders may attract import duties and taxes on arrival, for which you are responsible. We are not liable for delays caused by carriers, customs, or events outside our control.
7. Returns, refunds, and cancellation
Every piece we sell is made to your order. Because each item is produced only once you have placed an order, goods supplied by The Good Season are made to the consumer's specification within the meaning of regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the statutory 14-day cooling-off right therefore does not apply. We do not accept change-of-mind returns.
If your piece arrives damaged, broken, or otherwise faulty, we will replace it at our cost. Email us at hello@thegoodseason.co.uk within 30 days of delivery with your order number and photographs showing the damage. Full details of this process are set out in our Refund Policy.
Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015, including the right to goods of satisfactory quality, fit for purpose, and as described.
8. The Monaco Club
Membership benefits (such as member-only pricing, early access, and editorial perks) are offered at our discretion and may change or end on reasonable notice. Discount codes and member benefits are for personal use, cannot be exchanged for cash, and cannot be combined with other offers unless expressly stated.
9. Intellectual property
All content on the Site, including images, prints, artwork, text, logos, video, editorial, and code, is owned by The Good Season or our partners and is protected by copyright, trademark, and other intellectual property laws. You may view and share content for personal, non-commercial use. You may not copy, reproduce, resell, or otherwise exploit our content without our prior written consent. Artwork purchased from the Site is sold as a physical piece only; no intellectual property rights in the underlying work transfer with the sale.
10. User content
If you submit reviews, photographs, or other content to us, you grant The Good Season a worldwide, non-exclusive, royalty-free licence to use, display, and adapt that content for the purposes of operating and promoting the Site. You warrant that you own the content or have permission to share it, and that it does not breach any law or third-party rights.
11. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in breach of these Terms.
- Attempt to bypass security, scrape, or reverse-engineer the Site.
- Upload viruses, malware, or other harmful code.
- Use automated means to place orders or abuse promotions.
- Impersonate any person or misrepresent your affiliation with anyone.
12. Third-party links
The Site may contain links to third-party websites or services (including social platforms, artists' own sites, and payment providers). We are not responsible for the content or practices of those third parties and linking does not imply endorsement.
13. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under English law.
Subject to that, we are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of opportunity. Our total liability arising out of or in connection with an order is limited to the price paid for the goods in question.
14. Force majeure
We are not liable for any failure or delay in performing our obligations where caused by events outside our reasonable control, including strikes, courier failure, natural events, or disruption to essential services.
15. Privacy and cookies
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which form part of these Terms.
16. Changes to these Terms
We may update these Terms from time to time. The version in force at the time of your order is the one that applies to that order. We will post the current version on this page and update the "last updated" date above.
17. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Disputes arising from or relating to them will be resolved exclusively in the courts of England and Wales, save that consumers resident elsewhere in the UK or EU retain the benefit of any mandatory protections of their local law.
